Terms of Service

This Terms of Use Agreement (this "Agreement") governs your access to and use of the website located at http://alltourage.com (the "Website"), together with services and applications which are made available through the Website. 

LWTL Media Inc. (“LWTL Media”) owns the Website and such services and applications, or contracts with third parties to provide them to you. LWTL Media serves only as the platform provider, and any communication, hiring, or other decisions are solely those of the Employer, Job Seeker, or Candidate (as those terms are defined below) and not LWTL Media.

In consideration for your right to access and use the Website, you agree to the terms and conditions set out below.

As used in this Agreement, “you” means (and “your” refers to) the user of the Services, “we” means (and “us”, “our”, and “ours” refer to) LWTL Media, and “Services” means any and all services and products that are made available on or through the Website, unless otherwise provided herein. The effective date of this Agreement is when you accept it, in accordance with the terms and conditions that are set out below.

IMPORTANT! YOUR ACCESS TO ALLTOURAGE AND THE SERVICES IS SUBJECT TO LEGALLY BINDING TERMS AND CONDITIONS. CAREFULLY READ ALL OF THE FOLLOWING TERMS AND CONDITIONS BEFORE YOU PROCEED.  ACCESSING AND USING THE SERVICES IS THE EQUIVALENT OF YOUR SIGNATURE AND INDICATES YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS AND THAT YOU INTEND TO BE LEGALLY BOUND BY THEM. IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, DO NOT USE THE SERVICES.

You can view, print, download or save this Agreement at any time, under the “Terms of Service” link that appears on the Website.

Part 1 - Job Seekers

Part 1 applies only to a Job Seeker or Job Seekers (as those terms are described below in this Part). As used in this Part, "you" means (and "your" refers to) a Job Seeker, or Job Seekers, as the case may be.

Ready for a change? Alltourage is a platform that provides an opportunity for job seekers to explore jobs, apply easily, and launch their careers, today. Through the platform, Alltourage offers employers ("Employers"), human resource managers, referral sources ("Referrers"), candidates ("Candidates") and job seekers ("Job Seekers") tools to connect so that Job Seekers and Employers can be matched to potential opportunities.

To access certain Services, including the ability to upload a resume, to tell Employers why you'd be a great fit, and to add additional details about yourself, your targeted type of employment and compensation, you need to register for an account. 

To register, you must sign up and create an Alltourage account using the Website. This requires you to submit certain information, including your name, email address and a password. There will also be options for you to include additional information about yourself that is associated with your account, including the information described above. Additionally, you may choose to self-identify demographic diversity traits, including, but not limited to, race, ethnicity, gender, age, and sexual orientation ("Traits").If you choose to self-identify Traits, these Traits will only be visible to Alltourage administrators via database-driven analytics. They will not be shared directly with Employers, unless you choose to do so, or with your prior consent. 

In registering, you agree to provide accurate, current, and complete information about yourself and update it as necessary.

Part 2 - Employers

Part 2 applies only to Employers, including their human resource managers (each, an "HR Manager"). As used in this Part, "you" means (and "your" refers to) an Employer, or HR Manager, as the case may be.

Alltourage helps Employers generate leads for diversity and inclusion candidates for job postings. If you’re an Employer, you can sign up for an account and use Alltourage to post job postings and seek candidates through the platform’s network of Referrers and Candidates. Once you are registered for an account, you will be able to browse Job Seekers on the Service and be referred Candidates through Referrers. 

YOU UNDERSTAND THAT ALLTOURAGE DOES NOT INQUIRE INTO THE BACKGROUNDS OF ITS USERS OR ATTEMPT TO VERIFY THE STATEMENTS OF ITS USERS. YOU AGREE TO CONDUCT ANY BACKGROUND CHECKS, REFERENCE CHECKS, OR OTHER DUE DILIGENCETHAT YOU MAY REQUIRE BEFORE ENGAGING ANY CANDIDATE.

Alltourage may from time to time offer the ability for Employers to order a background check on Job Seekers through a third party application programming interface or service provider ("Background Check"). These Background Checks are subject to the terms set out in Section 3 below, and the terms and conditions of this Agreement.

In registering and creating job postings, you agree to provide accurate, current, and complete information about organization and posted employment opportunities, and update that information as necessary.

You also agree that you will only cause job postings to be forwarded by Referrers with whom you have an “existing business relationship”, an “existing non-business relationship”, a “personal relationship” or a “family relationship”, as those terms are defined in the statute known as An Act to promote the efficiency and adaptability of the Canadian economy by regulating certain activities that discourage reliance on electronic means of carrying out commercial activities, and to amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act (Canada) (“CASL”):

  • existing business relationship: a Referrer with whom you have an ongoing business relationship, or have had a business relationship with in the last two years before a job posting is forwarded;
  • existing non-business relationship: a Referrer with whom or with whose organization you have made a donation or gift to, volunteered with or for, or were a member of (in the case of an association), within the last two years before a job posting is forwarded;
  • personal relationship: a Referrer within whom you have a personal relationship, considering factors such as the sharing of interests, experiences, opinions and information set out in previous communication with the Referrer, the frequency of communication, the length of time since you communicated or whether you have met in person; and
  • family relationship: a Referrer who is related to you through a marriage, common-law partnership or any legal parent-child relationship.

    Further, you will not use the Services to send to a Candidate any information that is not related to the job posting, without the Candidate’s consent.

Part 3 - Referrers

Part 3 applies only to Referrers. As used in this Part, "you" means (and "your" refers to) a Referrer.

Referrers are people who sign up for accounts and are able to refer job postings to personal acquaintances who they believe may be a good fit for the position.

In registering as a Referrer, you agree to provide accurate information about yourself, and to provide accurate information about how you know the person you are referring, and your relationship to that Candidate. 

You also agree that you will only forward job postings to Candidates with whom you have an “existing business relationship”, an “existing non-business relationship”, a “personal relationship” or a “family relationship”, as those terms are defined in CASL and are summarized above.  Further, you will not use the Services to send to a Candidate any information that is not related to the job posting, without the Candidate’s consent.

Part 4 - Candidates

Part 4 applies only to Candidates. 

Candidates are personal acquaintances who receive referrals to job postings from referrers, and who can use Alltourage to learn more about specific opportunities.

If you choose to apply to a job through a referral, as a Candidate, you agree to provide accurate information about yourself. If you are a Candidate who wishes to register for an account, you will be subject to the terms applicable to Job Seekers, above, and to the general terms and conditions applicable to all users.

Part 5 - General Terms and Conditions

Part 5 applies to all users of the Website. 

  1. Accounts and User Interaction
    We reserve the right to refuse registration of accounts, or to cancel any existing accounts, that we deem to be inappropriate, in our sole discretion. If you use the Services, you are solely responsible for maintaining the confidentiality of your account and password, and you agree to accept responsibility for all activity that occurs under your account. We are not responsible for updating your account.  When you provide information to us, you represent and warrant that you have legal authority to do so. In particular, you represent and warrant that: you are entitled to submit the information to us; the information is accurate; and the information is not confidential, in violation of any contractual restrictions or third party rights.

    We provide you with the opportunity to connect with other Alltourage users for job opportunities, but you are ultimately responsible for your decision to pursue a particular opportunity or connect with a potential Employer or Referrer. We take no part in any communication you have with other users, and we are not responsible for, or a party to, any agreements you may enter into with such users, including, but not limited to, employment, independent contractor, or other agreements.
  2. Your Personal Information and Privacy
    Some of the Services you to provide basic information about yourself and may require you to let us share some of this information with others, such as potential Employers, so that they can have the opportunity to connect with you and review your suitability as a candidate for their position.

    You expressly consent to our collection, use and disclosure of the personally identifiable information you provide to us when you register for and use the Services, in accordance with the Alltourage Privacy Policy. You can click here to review our Privacy Policy, which explains what personally identifiable information we collect, how we use it and with whom it is shared.
  3. Background Checks
    As part of its delivery of Services, Alltourage may from time to time offer the ability for Employers to order a Background Check on Job Seekers through a third party application programming interface or service provider. Currently this service is only offered to Canadian users.

    If you are a Job Seeker or Candidate, you consent to Employers using this service to conduct one or more Background Checks on you. If you do not consent to having a Background Check conducted on you, your option is to not use the Services.

    If you are an Employer, you are solely responsible for ensuring your use of Background Checks complies with all applicable laws, including consumer protection and privacy laws which require consent from the Job Seeker or Candidate.  Please be advised that, depending on the nature of the Background Checks, additional consent from and disclosure to the Job Seeker or Candidate may be required.

    ALL BACKGROUND CHECKS ARE CONDUCTED AND PROVIDED BY THIRD PARTIES. ALLTOURAGE SPECIFICALLY DISCLAIMS ANY RESPONSIBILITY OR LIABILITY FOR THE ACCURACY, COMPLETENESS, CORRECTNESS, TIMELINESS OR USEFULNESS OF BACKGROUND CHECKS OR THE SUITABILITY OF ANY CANDIDATE OR JOB SEEKER.  YOUR USE OF BACKGROUND CHECKS IS SUBJECT TO ANY TERMS AND CONDITIONS OF THE THIRD PARTY SERVICE PROVIDER(S) WHO PROVIDE THAT SERVICE.
  4. Consent to Electronic Communication
    When you visit the Website, use the Services or send email to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by email or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
  5. Modification to Alltourage and this Agreement
    We may revise this Agreement, at any time, by updating this posting.  We may provide notice to you of such revisions by means of a general notice on the Website.  Your continued use of the Services after such revisions are posted will signify your agreement to these revised terms.  Therefore, you should visit this page periodically to review this Agreement.
  6. Ownership of Content
    Our Content
    : Except for Your Content (which is discussed below), all materials displayed or otherwise accessible on the Website, including, without limitation, text, photographs, images, illustrations, graphics, icons, code (collectively, "Our Content") and the selection and arrangement of Our Content on the Website are protected by copyright, pursuant to Canadian copyright laws, international conventions and other copyright laws. We either own the intellectual property rights, including copyright, or have acquired the necessary rights or licences, in Our Content.  Portions of Our Content may have been licensed to us or published on the Website by third parties. Any reproduction, modification, publication, transmission, transfer, sale, distribution, display or exploitation of the Website or Our Content, whether in whole or in part, without our express written permission, is strictly prohibited.  The display of Our Content does not imply that you have been granted a license by us or other entities with respect to it.

    Your Content
    : You retain ownership in and to materials you submit to us, including, without limitation, your resume, text, photographs, images, illustrations, graphics and icons (collectively, "Your Content"), but you agree to grant us a non-exclusive, transferable, sub-licensable, royalty-free, worldwide licence to use Your Content, as we see fit, in our sole discretion, for the purpose of providing the Services and supporting our operation of Alltourage, generally, in accordance with our Privacy Policy. We reserve the right to disclose Your Content, at any time, as is required to comply with applicable laws, and the right to remove any of Your Content that is in violation of the terms and conditions of this Agreement. You also agree that any rights you assert in and to Your Content will be subject to standards of commercial reasonableness.  You may request deletion of Your Content, but our ability to delete Your Content may be restricted if you have shared it with others.

    Trademarks
    : Certain words, phrases, names, designs or logos on the Website may constitute trademarks, services marks, or trade names that are owned by us or others. The display of such marks on the Website does not imply that you have been granted a licence by us or others with respect to them.
  7. Complaints
    If you believe in good faith that any material that is made available on the Website infringes your copyright, or if you have any other complaints about your use of the Services, please contact us at support@alltourage.com. You can also contact us if another Member provides content or otherwise uses the Services in a way that you find objectionable.  While we are not responsible for how others use the Services, we will make commercially reasonable efforts to make your use of the Services enjoyable.
  8. Limited Licence
    Subject to the terms and conditions of this Agreement, you are granted a limited personal, non-exclusive, non-transferable, revocable license to access, view and use the Website, including a limited license to download, print and store single copies of Our Content from the Website, for your personal use, provided that you maintain all copyright and other notices contained in such items and you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, in the Website. Our Content must not be reproduced, republished, or disseminated in any manner or form without our prior written consent or the prior written consent of the third parties from which such information was collected, as the case may be.
  9. Acceptable Uses of Alltourage
    While you use the Services, you must comply with all applicable laws, rules and regulations, as well as this Agreement and the Alltourage Privacy Policy. In addition, your use of the Services is based on the following rules of conduct.  You will not:
    • Post, transmit, or otherwise make available any material that is or may be (a) threatening, harassing, degrading, hateful, or intimidating; (b) defamatory; (c) fraudulent or tortious; (d) obscene, indecent, pornographic, or otherwise objectionable; or (e) an infringement of another person's privacy by disclosing the personal information of another individual without their knowledge and consent.
    • Post, transmit, or otherwise make available any material that may violate the proprietary rights of any third party, including, without limitation, copyrighted software, photographs, texts, videos or artwork or any moral rights associated therewith.
    • Use the Website in a manner which will violate or solicit the violation of any applicable local, provincial, territorial, state, national or international law, rule or regulation, including, without limitation, applicable privacy laws and CASL.
    • Use the Website to post transmit, or otherwise make available any material which would: (a) give rise to criminal or civil liability; (b) encourage conduct that constitutes a criminal offence; or (c) encourage or provide instructional information about illegal activities.
    • Impersonate any person or entity, including, but not limited to, any of our representatives; falsely state or otherwise misrepresent your affiliation with any person or entity; or express or imply that we endorse any statement you make without our prior written consent.
    • Use the Website or the Services in a manner that is in competition with Alltourage.
    • Post, transmit, or otherwise make available any virus, worm, trojan horse, spyware, or any other computer code, file, or program that may, or is intended to, damage or hijack the operation of any hardware, software, server or telecommunications equipment.
    • Interfere with or disrupt the Website.
    • Use Alltourage in any manner to harass, abuse, stalk, threaten, defame or otherwise infringe or violate the rights of any other party.
    • Post, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," investment opportunity, or any other form of solicitation.
    • Use Website or the Services, if you are a minor. Parents and legal guardians are responsible for ensuring their children do not use Alltourage.
    • Use the Website or the Services if you are in violation of this Agreement.

    Any person who is found or reasonably suspected to have violated the rules of conduct provided above may be barred from using the Website, in our sole discretion, and may be subject to other legal remedies.
  10. Practices Regarding Use and Storage
    Storage or Deletion of Content
    : You agree that we have no responsibility or liability for the deletion of, or the failure to store or to transmit, any information maintained by us, including, without limitation, Your Content and Our Content. We will provide you access to Your Content, through your use of your account, but we are not responsible for copying, extracting or otherwise transferring Your Content to you.

    Limits on Storage
    : We retain the right to create limits on use and storage, at our sole discretion, at any time, with or without notice.

    Our Access to Stored Content: We also reserve the right to access, read, preserve, and disclose any information as we reasonably believe is necessary, including, without limitation, Your Content, to: (a) satisfy any applicable law, regulation, legal process or governmental request; (b) enforce this Agreement, including investigation of potential violations hereof; (c) detect, prevent, or otherwise address fraud, security or technical issues; (d) respond to user support requests; or (e) protect our rights, property or safety, our users or the public. We will not be responsible or liable for the exercise or non-exercise of our rights under this Agreement.
  11. Customer Service
    We may make customer service features available to you, as a courtesy only.  We are not obliged to provide customer service to you and our decision to do so shall not create an obligation to provide additional customer service to you.
  12. Linking and other Websites
    No Endorsement or Responsibility
    : In addition to offering you access to job listings, potential employers, referral sources, Candidates, and Job Seekers, the Website may include links to other websites, solely as a convenience to users. We do not endorse any users, linked websites or the information, material, product, services or opportunities created by, listed in, or contained on linked websites or accessible through other users or linked websites. We make no express or implied warranties with regard to the information, material, product, services, or opportunities that are contained on or accessible through other users and linked websites.

    Use at Your Own Risk: Your access to and use of other users' and linked websites, including information, materials, products, services, and opportunities on linked websites or available through other users' and linked websites, is solely at your own risk and, with respect to linked websites, is governed by the terms of service of the linked website. If there is any conflict between this Agreement and any of the terms or notices set forth on any other website, then the terms of that other website will control your use of that link. Please review the terms of use for each link so that you understand all of the terms that will apply. You should note that the Internet is an inherently insecure medium, and sending any online communication provides no guarantee of successful delivery. Care should be taken to ensure that the content of your online communication is not sensitive or confidential, since we can take no responsibility for communication which is lost, delayed, or misdelivered.

    Linking to the Website: Please request permission to link to the Website prior to linking to the Website. We reserve the right to cancel and revoke any permission we may give to link to the Website at any time, for any reason, without any notice, and without any liability to you or any other person.
  13. No Warranty
    NO WARRANTY
    : EXCEPT AS EXPRESSLY PROVIDED IN THIS AGREEMENT, WE DO NOT MAKE OR GIVE ANY REPRESENTATION, WARRANTY OR CONDITION OF ANY KIND, WHETHER EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES AS TO UNINTERRUPTED OR ERROR FREE TRANSACTIONS, PRIVACY, SECURITY, MERCHANTABILITY, QUALITY, TITLE, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE, OR THOSE ARISING OUT OF A COURSE OF DEALING OR USAGE OF TRADE.

    Use at Your Own Risk: Access to the Services is provided "as is" and without warranties of any kind, either express or implied. By accessing and using the Services, you acknowledge and agree that it is entirely at your own risk. We are not responsible for your reliance on the Services. While we try to keep the Services available without interruption, we are not responsible for ensuring the Services are available or that they will convey information to anyone, on your behalf.

    Agreements and Interaction with Users
    : Alltourage allows you to connect with other users for the purposes of employment or other opportunities. WE ARE NOT A PARTY TO ANY RELATIONSHIPS OR AGREEMENTS YOU MAY HAVE WITH OTHER USERS, AND AS SUCH, YOU ARE SOLELY RESPONSIBLE FOR ALL AGREEMENTS AND ARRANGEMENTS YOU ENTER INTO, AND INTERACTION YOU HAVE, WITH OTHER USERS, INCLUDING, BUT NOT LIMITED TO: (A) SUITABILITY FOR A PARTICULAR PURPOSE; (B) ACCURACY OF DATA OR INFORMATION; AND (C) ANY CONDUCT OF ANY OTHER USER. YOU AGREE THAT YOU WILL HAVE NO RECOURSE OR REMEDY AGAINST US, EXCEPT AS EXPRESSLY SET OUT IN THIS AGREEMENT. WE DO NOT CONDUCT BACKGROUND OR REGISTRY CHECKS ON OTHER USERS OR VERIFY ANY STATEMENTS THEY MAKE. BACKGROUND CHECKS AVAILABLE TO EMPLOYERS THROUGH THIS PLATFORM ARE CONDUCTED BY THIRD PARTIES. BY USING THIS THIRD PARTY SERVICE YOU ACKNOWLEDGE AND AGREE THAT ALLTOURAGE IS NOT RESPONSIBLE FOR THE ACCURACY, COMPLETENESS OR SUITABILITY OF ANY BACKGROUND CHECK. WITHOUT LIMITING THE FOREGOING, WE MAKE NO REPRESENTATIONS ABOUT, AND DO NOT GUARANTEE, AND YOU AGREE NOT TO HOLD US RESPONSIBLE FOR: (D) THE QUALITY, SAFETY OR LEGALITY OF ANY JOB SEEKER, CANDIDATE, REFERRAL OR JOB POSTING; (E) THE QUALIFICATIONS, BACKGROUND OR IDENTITIES OF JOB SEEKERS AND CANDIDATES WHETHER REFERRED OR NOT; (F) THE ABILITY OF JOB SEEKERS AND CANDIDATES TO PERFORM THE DUTIES OF ANY JOB; (G) THE ABILITY OF EMPLOYERS TO PAY FOR ANY JOB DUTIES PERFORMED BY A JOB SEEKER OR CANDIDATE; AND (H) THE QUALITY OF ANY REFERRAL MADE THROUGH THE SERVICES.

    You agree to take whatever precaution is reasonably necessary, when you interact with, communicate with, or enter into agreements or arrangements with other users, whether through the Alltourage platform, or in person.

    Third Party Information
    : We are not responsible for any materials or information on the Website or any linked website that you may find offensive, undesirable or objectionable.  Further, we specifically disclaim any responsibility or liability for the accuracy, completeness, correctness, timeliness or usefulness of third party information.

    Third Party use of Your Content: Be aware that information you share on your profile and resume will be available to others. We are not responsible for what others do with Your Content, once you post it on your account and share it with another user.

    Verification
    : We are not responsible for verifying your identity, the identity of anyone who uses your account, or the identity or legitimacy of any other user, posting, resume, or profile.

    No Endorsement
    : Alltourage does not endorse and user or any job opportunity. Users are required by this Agreement to provide accurate information, and although Alltourage may undertake additional checks and processes designed to help identify or check identities, backgrounds, or information about users, at our sole discretion, we do not make any representations about, confirm, or endorse any user, the user's purported identity, Traits or background, or information they provide.
  14. Limitation of Liability, Release and Indemnity
    THIS SECTION LIMITS OUR LIABILITY TO YOU AND PROVIDES FOR A RELEASE AND AN INDEMNITY, FROM YOU, IN FAVOUR OF US.  PLEASE READ IT CAREFULLY.

    LIMITATION OF LIABILITY
    : UNDER NO CIRCUMSTANCES SHALL YOU BE ENTITLED TO RECOVER ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES FROM US, ARISING DIRECTLY OR INDIRECTLY FROM: (A) ANY BREACH OF THIS AGREEMENT, FUNDAMENTAL OR OTHERWISE; OR (B) ANY OF OUR NEGLIGENCE, ACTS OR OMISSIONS; OR (C) ANY PROVISION, DUTY OR REQUIREMENT OF ANY STATUTE; OR (D) THE CONDUCT, ONLINE OR OFFLINE, OF ANY USER, OR (E) ANY DUTY AT LAW OR IN EQUITY.  UNDER NO CIRCUMSTANCES SHALL OUR LIABILITY TO YOU FOR DIRECT DAMAGES YOU SUFFER ARISING OUT OF, RELATED TO OR CAUSED BY THIS AGREEMENT OR YOUR USE OF THE WEBSITE OR THE SERVICES EXCEED A MAXIMUM AMOUNT EQUAL TO THE AMOUNT ACTUALLY PAID BY YOU TO US. YOU ACKNOWLEDGE THAT THESE LIMITATIONS OF LIABILITY CONTAINED IN THIS SECTION 14 REFLECT THE ALLOCATION OF RISK SET FORTH IN THIS AGREEMENT AND THAT WE WOULD NOT ENTER INTO THIS AGREEMENT WITHOUT THESE LIMITATIONS ON LIABILITY.

    RELEASE
    :   EXCEPT AS SET OUT IN THIS SECTION 14, YOU AGREE TO RELEASE, REMISE, ACQUIT AND DISCHARGE US FROM ANY CLAIMS, ACTIONS, DEMANDS, COSTS AND EXPENSES OF ANY KIND WHATSOEVER, WHETHER IN CONTRACT, NEGLIGENCE OR TORT, AT LAW OR IN EQUITY, OR BY STATUTE OR OTHERWISE, HOWSOEVER CAUSED, WITH RESPECT TO YOUR USE OF, OR OUR OPERATION OF, THE WEBSITE AND THE SERVICES.

    INDEMNITY:

  15. Conflict of Laws
    Application of British Columbia Laws
    : We are physically located, and all activities with respect to the Services and the Website take place, within the Province of British Columbia, Canada. This Agreement will be governed by the laws of the Province of British Columbia and the laws of Canada applicable therein and shall be treated in all respects as a British Columbia contract, without reference to the principles of conflicts of law. In the event of a dispute, you agree to submit to the exclusive jurisdiction of British Columbia’s courts.

    Laws Excluded: We expressly exclude the UN Convention on Contracts for the International Sale of Goods, and The International Sale of Goods Act (British Columbia), R.S.B.C. 1996, c. 236, as amended, replaced or re-enacted from time to time.

    Waiver of Rights: You agree to waive any right you may have to: (a) a trial by jury; and (b) commence or participate in any class action against us related to your use of the Services, the exchange of electronic documents between us or this Agreement and, where, applicable, you also agree to opt out of any class proceedings against us or our licensors.

    Agreement in English: The parties hereto have required that this Agreement and all documents relating thereto be drawn up in English. Nous avons demandé que cette convention ainsi que tous les documents qui s’y rattachent soient rédigés en anglais.
  16. International Matters
    Unless otherwise specified, the Website and the Services are presented solely for the purpose of providing products and services in Canada. We make no representation that the Website, the Services, Our Content and all other materials on the Website are appropriate or available for use in any particular location. Those who choose to access the Website do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
  17. Force Majeure
    We will not be liable for failure or delay in our performance of our obligations under this Agreement due to any cause beyond our reasonable control, including, but not limited to: (a) acts of God; or (b) failure or disruptions in third-party-controlled or operated communications facilities; or (c) worms, viruses and other disabling or disruptive software, communications or files.
  18. Termination
    Suspension of your Use of the Website by you
    : You may terminate this Agreement at any time, by cancelling your account. Your termination will be effective when we receive notice of your termination.

    Suspension of your Use of the Website by us
    : If you breach any provision of this Agreement, you may no longer use the Website. We may at any time and for any reason, with or without cause, and in our sole discretion, immediately suspend or terminate (in whole or in part) your permission to use the Website or the Services, all without any notice or liability to you or any other person.

    No Refunds or Rights on Termination:  We shall not be responsible for refunding or otherwise paying any funds, amounts or credits that we may owe to you if we have suspended or terminated your permission to use the Website or any part thereof.  We reserve the right to cease, suspend or interrupt operation of or access to the Website or any part thereof, and shall not be required to provide any notice in respect of such cessation, suspension or interruption of access, nor shall we have any liability for such cessation, suspension or interruption of access.

    Survival
    :  The provisions of Sections that are by their nature intended to survive termination of this Agreement shall survive termination of this Agreement including, but not limited to, Sections 234610121314151619 and this Section 18.
  19. Miscellaneous
    Our failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.  If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.  We may assign this Agreement without restriction.

Privacy Policy

1. Scope and Application

This Privacy Policy applies to personal information, in any form, collected, used or disclosed by Alltourage in the course of commercial activities.  It will not typically apply to information directly regarding Alltourage's corporate clients.  However, such information may be protected by other Alltourage policies and through contractual arrangements.

This Privacy Policy does not impose any limits on the collection, use or disclosure of the following information by Alltourage:

  • information about an individual that is publicly available and is specified by regulation pursuant to PIPEDA;
  • personal information that is not collected, used or disclosed, for commercial purposes;
  • non-personally identifiable information; and
  • the name, title, business address or telephone number of an employee of an organization, where collection, use or disclosure of such information is solely for the purpose of communicating with the person about their employment, business or profession. 

The application of this Privacy Policy is subject to the requirements and provisions of PIPEDA, and any other applicable legislation or regulation. If you reside in British Columbia, Alberta or Québec, then the substantially similar provincial privacy law of your province will apply to our handling of your personal information, rather than PIPEDA.  In that case, reference in this Privacy Policy to PIPEDA shall be deemed to include your province's substantially similar privacy law.


2. Definitions

collection:  The act of gathering, acquiring, recording, or obtaining personal information from any source, including third parties, by any means.

consent:  Voluntary agreement for the collection, use and disclosure of personal information for defined purposes.  The form of consent we seek may vary, depending upon the circumstances and the type of personal information.  In determining the form of consent, we take into account the sensitivity of the personal information and your reasonable expectations.  Consent may be provided directly by you, or by your authorized representative, in accordance with applicable law.

disclosure:  Making personal information available to a third party.

employee:  An employee of, or an independent contractor to, Alltourage.  The inclusion of independent contractors within the definition of "employee" is for convenience of reference only, and should in no manner imply that such independent contractors are our employees within the meaning of employment legislation or are in an employee-employer relationship with us.

personal information:  Information about an identifiable individual, but does not include information that is used for the purpose of communicating or facilitating communication with an individual in relation to their employment, business or profession, such as the individual’s name, position name or title, work address, work telephone number, work fax number or work electronic address.  Where an individual provides their home address to Alltourage as their business contact information, Alltourage considers it to be business contact information, and is therefore not subject to protection as personal information.  Information about corporations is not considered personal information.

third party:  An individual or organization outside of Alltourage.

use:  The treatment, handling, and management of personal information by and within Alltourage or by a third party with the knowledge and approval of Alltourage.


3. How Alltourage Works

Alltourage is a platform that helps employers generate leads for diversity and inclusion candidates for job postings. If you’re an employer, you can sign up for an account and use Alltourage to post job postings and seek candidates through the platform’s network of referrers and candidates. Referrers are people who sign up for accounts and are able to refer job postings to personal acquaintances who they believe may be a good fit for the position. Candidates are personal acquaintances who receive referrals to job postings from referrers, and who can use Alltourage to learn more about specific opportunities. Job seekers are people who use Alltourage to find jobs and who may use Alltourage to apply for those jobs.


4. Accountability for our handing of personal information

Alltourage is responsible for all personal information under its control and has designated the Alltourage Privacy Officer to oversee privacy compliance.  Other individuals within Alltourage may be delegated to act on behalf of our Privacy Officer or to take responsibility for the day to day management of personal information. Alltourage trains and communicates with employees about our privacy practices, including this Privacy Policy. 

As appropriate, Alltourage implements privacy policies and procedures to properly enforce this Privacy Policy, and we use contractual or other means to provide a comparable level of privacy protection while personal information is being processed or used by a third party. 


5.Reasons why we collect, use and disclose personal information

Alltourage collects personal information from you for the following purposes:

  • to verify your identity when you create an account;
  • to notify you about products or services we offer or provide (including job postings, in the case of job seekers or candidates, or potential candidates, in the case of employers);
  • to provide you with information, products, or services that you request from us;
  • to help us coordinate and manage our employees and volunteers;
  • to personalize and improve your use of Alltourage, such as through the use of automated systems to help connect you with job postings; 
  • to improve our products or services, for marketing and newsletters, or customer relationships and experiences;
  • to carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal or regulatory requirements;
  • in any other way we may describe when you provide the information; and
  • for any other purpose with your consent, or as required or permitted by law. 

Further reference to “identified purposes” mean the purposes identified in this section of this Privacy Policy.

We will indicate the identified purposes to you, orally, electronically or in writing, at or before the time your personal information is collected.  Persons collecting personal information may explain the identified purposes or refer individuals to a designated person within Alltourage who can explain these identified purposes.


6. Collection of personal information

If you request information, products or services from Alltourage, we will collect your name and contact details, such as your email address, mailing address, telephone number and language preference. In addition:

  • If you have an employer account, we will collect information about the profile of your organization, job postings you may submit to us from time to time and your payment information.
  • If you have a referrer account, we will collect information you provide us about individual candidates with whom you have a personal relationship and who you believe may be a good fit for a job posting, such as their skills and attributes, how long you have known them and the nature of your relationship with them.
  • If you have a job seeker account, including an account which a candidate has chosen to create, we will collect information you provide us about yourself, such as information from social media profiles which you share with us, your education, work, salary and location preference and your resume. If you choose to self-identify any demographic diversity traits, we will associate that information to your profile but will not disclose it to an employer or referrer, without your permission.

If you engage with our social media accounts, we will collect whatever information you provide to us through the applicable platform.

You may also provide us your credit card or other payment information in order to pay for products and services we make available to you, from time to time. We collect this information only for the purposes we indicate to you at the time of collection. 

We collect and retain information about your transaction history when you use our products and services. 

We may also provide you an opportunity to specify certain preferences in respect of our products or services. If you choose to provide such information, we will collect and implement your preferences. This may include information about your profile that you choose, through your account, to make available to employers and referrers who use Alltourage. If you are referred to a job posting, you decide if you want to submit your name to the employer who posted the job. 

Alltourage will only collect personal information that is necessary for the purposes identified in this Privacy Policy or as otherwise agreed to by you.  

In most cases, we collect your personal information directly from you.  Sometimes, however, we use third parties to provide us your personal information:

  • where a referrer has provided information to an employer regarding a candidate’s suitability for a job posting, such as the candidate’s skills and attributes, how long the referrer has known them and the nature of their relationship with them; or
  • where an employer wishes to conduct a background check, information will be collected from third parties in connection with that background check.  More information about background checks is provided in section 8 below.

We collect no personal information about you unless you choose to provide that information to us. We do not use techniques that collect personal information about anyone without their knowledge. We only collect personal information about individuals when they specifically and knowingly provide it to us, for example, when they fill out a registration form on our website or contact us by telephone or email. As a limited exception to this principle, we may collect personal information without your consent:

  • where permitted by PIPEDA and other applicable laws; or
  • from any referrer who has a personal relationship with you, and who refers you to a job posting.  In this case, we will send you details about the job posting and a link to learn more about the job.

You may withdraw consent at any time, subject to legal or contractual restrictions and reasonable notice. You may contact us for more information regarding the implications of withdrawing consent.


7. Consent for us to contact you about our products and services

The information you provide to Alltourage – such as your name, address, etc. – allows us to inform you about job postings (in the case of job seekers and candidates) or potential candidates who may be a good fit for your organization (in the case of employers), and to notify you of issues, events or special offers which may be of interest to you. 

By signing up for an account, you are giving Alltourage permission to contact you by way of the information you provide. Should you wish not to be contacted by Alltourage, please opt out under Alltourage’s Account Settings and Preferences, or contact support@alltourage.com to do so.

8. Disclosure of personal information

Alltourage will not disclose personal information for purposes other than those purposes for which it was collected, except with your consent or as required or permitted by law. Alltourage may disclose your personal information:

  • to fulfill the identified purposes (for example, by providing your name to an employer, but only if you are a job seeker or candidate who has expressed an interest in a job posting);
  • for the purposes of permitting a third party service provider to conduct a background check. The information disclosed by Alltourage for the purposes of a background check will be limited to the job seeker’s or candidate’s: name, email and phone number. The third party service provider may collect additional information about the job seeker or candidate, depending on the nature of the background check.  Background checks are subject to the third party service provider’s terms and conditions and we recommend you review those terms and conditions before you provide your consent to a background check. Currently, this service is only available to Canadian users;
  • when we have your consent, whether express or implied;
  • to your authorized representatives;
  • if and when we are involved in a corporate reorganization or if we sell or lease all or part of our business; 
  • to meet legal and regulatory requirements; and
  • where required or permitted by law.   

In such circumstances, we will not disclose more information than is required for the purpose for which the information is being disclosed.  We will also, whenever it is reasonable and practicable to do so, enter into privacy agreements with third parties with whom we share personal information.   

Information you submit to your public profile is made available to HR Managers and Employers (as those terms are defined in our Terms of Use).  If you do not want these Alltourage users to view this information, do not submit it to Alltourage.

We will retain personal information only as long as it remains necessary or relevant for the identified purposes or as required or permitted by law.  Where personal information has been used by us to make a decision about you, Alltourage shall retain, for a period of time that is reasonably sufficient to allow for access by you, either the actual information or the rationale for making such decision.  

Only our employees who require access for legitimate reasons or whose duties reasonably so require, are granted access to personal information.  

We maintain reasonable controls, schedules and practices for personal information management retention and destruction.  Personal information that is no longer necessary or relevant for the identified purposes, or is required by law to be retained, is destroyed, erased or made anonymous, as appropriate in the circumstances.

Alltourage may share aggregate information – not personal information – about its employers, referrers, candidates, and job seekers with other parties and related service providers, to help them better understand Alltourage users and their interests.  Such aggregate information is used to give Alltourage demographic data about its users in order to improve our organization and the products and services we provide. 

If you are a referrer, we keep track of the average number of referrals you make through Alltourage, as well as information relative to the average number of candidates who you referred, who apply for job postings through Alltourage.


9. Alltourage website

Our website may use various technologies, from time to time, to:

  • help us customize your experience on our website;
  • track your use of our website for advertising, marketing, or promotional purposes; 
  • help us determine whether you opened an email message from us; or
  • gather information to deliver advertisements about products and services we think may be of interest to you.

This information enables us to:

  • customize the services we offer you, to improve our website;
  • estimate our audience size and usage patterns;
  • store information about your preferences, allowing us to customize our website according to your individual interests, including showing you advertisements that we think will be of interest to you;
  • speed up your searches;
  • recognize you when you return to our website; 
  • show our advertisements on external sites; and
  • assist us in providing a better customer experience by understanding consumer behaviour.

Your choices about how our website collects your information

We strive to provide you with choices regarding the personal information you provide to us. 

You can opt out of several third party ad servers’ and networks’ cookies simultaneously by using opt out tools created by Google Advertising, the Digital Advertising Alliance of Canada or by the Network Advertising Initiative. You may also opt out of our use of Google Analytics by visiting the Google Analytics opt out page. We may have reporting of your aggregate interactions with our ads across the Google Display Network or DoubleClick for Advertisers in conjunction with activity on our website.

You can also access these websites to learn more about online behavioural advertising and how to stop websites from placing cookies on your device. Opting out of a network does not mean you will no longer receive online advertising. It does mean that the network from which you opted out will no longer deliver ads tailored to your web preferences and usage patterns. 

In addition, we have created mechanisms to provide you with the following control over your information:

  • Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. To learn how you can manage your Flash cookie settings, visit the Flash player settings page on Adobe’s website. If you disable or refuse cookies, please note that some parts of this website may not be accessible or may not function properly. 

 

  • Promotional Offers. If you have opted in to receive certain emails from us but no longer wish to have your email address/contact information used by Alltourage to promote our own or third parties’ products or services, you can opt out by contacting Alltourage support: support@alltourage.com. If we have sent you a promotional email, you may unsubscribe by clicking the unsubscribe link we have included in the email. 
  • If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt out by using the opt out tools created by the Digital Advertising Alliance of Canada, the Network Advertising Initiative or Google Advertising.

10. Accuracy of personal information

We make reasonable efforts to ensure that personal information we collect, use or disclose is as accurate, complete and up-to-date as necessary for the purposes for which it is to be used. Please be advised, however, that Alltourage is driven by third party referrals, the accuracy of which we cannot control. In addition, we use algorithms to generate a profile for you, based on information about you that you and referrers have submitted to Alltourage, and that profile is used to help match you to job postings.

If you find any errors in our personal information holdings (including information provided by a third party referral or generated by an algorithm), we should be informed so that we can make the appropriate corrections. We will convey these corrections to any third party that may have been provided inaccurate information. For personal information that remains in dispute, we will make note in our records of your opinion as to accuracy of the relevant personal information. 


11. Security of personal information

The security of your personal information is very important to us. We use physical, electronic, and administrative measures designed to prevent any unauthorized access, disclosure, copying, use, or modification of personal information. Safeguards include securing physical documents and technological measures by way of secure access and encryption. We store all information you provide to us behind firewalls on our secure servers. Any payment transactions (if applicable) will be encrypted using TLS technology.

Alltourage employees are authorized to access personal information based only on their need to deal with the information for the reason(s) for which it was obtained. Safeguards are in place to ensure that the information is not disclosed or shared more widely than is necessary to achieve the purpose for which it was gathered. We also take measures to ensure the integrity of this information is maintained and to prevent its being lost or destroyed.

We protect personal information disclosed to third parties by contractual agreements stipulating the confidentiality of the personal information and the purposes for which it is to be used.  

We may engage service providers to assist us with fulfilling the purposes for which personal information has been collected, used and disclosed, and, in some instances, these service providers may be located outside Canada. We only select service providers that protect personal information in a manner that is comparable to the protection we provide under our own privacy policies.  However, personal information may be subject to, and accessed under, the laws of the countries in which our service providers operate.  If you have any questions about our transfer of personal information to our service providers outside Canada, or if you would like to learn more about our privacy policies in that regard, please contact the Alltourage Privacy Officer at the contact information provided below.  


12. Openness concerning our policies and procedures

We are open about the policies, procedures and practices we use to protect your personal information. Information about these policies, procedures and practices will be made available to you either electronically or in writing.


13. Access to your personal information

You may access any personal information that we have concerning you, and which has been collected, used or disclosed for a commercial purpose, by sending a written request to the Alltourage Privacy Officer. Alltourage may advise you in advance if there is a minimal charge to conduct a search of our records and will respond within 30 days, or advise that the request for access is subject to an extension as authorized by PIPEDA. 

To protect your privacy, you may be required to provide sufficient identification, in order to permit us to account for the existence, use and disclosure of certain personal information and to authorize access to such information. Any such information will only be used for this purpose.

We may not be able to provide personal information to you if doing so would violate the privacy of a third party or if certain personal information is subject to legal privilege, contains information proprietary to us or a third party, is too costly to retrieve, or cannot be disclosed for other legal reasons.  If we are unable to provide access to all or part of your personal information, we will explain our reasons for such a decision.

Where you have been provided with access to your personal information, you shall be able to challenge the accuracy and completeness of your personal information and have it amended as appropriate.  

Personal information that is disclosed to third parties by us will be subject to the general laws applicable in the jurisdiction in which the third party conducts business. As a result, and in certain limited situations, we may not be legally permitted to account for certain collections, uses or disclosures of personal information. In most circumstances, however, we shall provide an account of the collection, use and disclosure of personal information and, where reasonably possible, we shall state the source of the personal information. In providing an account of disclosure, we shall provide a list of organizations to which we may have disclosed your personal information when it is not possible to provide an actual list.  

14. Challenging compliance with privacy laws

All questions or concerns regarding our privacy practices should be directed to the Alltourage Privacy Officer.  

We will investigate all complaints concerning compliance with this Privacy Policy and if a complaint is found to be justified, we will take appropriate measures to resolve the complaint including, if necessary, amending our privacy policies and procedures.  We will inform you of the outcome of the investigation regarding your complaint.


15. Language
